An Australian vegan has lost her Supreme Court battle over the smell of meat and fish from her neighbour's barbecue.
Perth resident Cilla Carden told the court that both of her neighbours have been deliberately cooking meat, smoking and making noise outside.
The Western Australia Supreme Court found her claim to be “not reasonable” and said it would have stopped her neighbours from enjoying their own gardens.
Dismissing her appeal Supreme Court Chief Justice Peter Quinlan encouraged all parties to “direct their considerable energies towards the resolution of their differences as best they can.”
Overnight, Ms Carden told Australia’s Nine News that she is considering further legal action.
“They’ve put it there so I smell fish, all I can smell is fish,” she said.
“I can’t enjoy my back yard; I can’t go out there.”
She said she just wants to “live my life in peace and to get on with my life.”
In a statement to Nine News, her neighbour, who wished to remain anonymous, said: “Ms Carden’s demands were proven to be not reasonable and indeed were to the detriment of the other owners’ ability to enjoy their lots in a reasonable and acceptable manner.”
