A convicted killer has brought a High Court challenge against sanctions imposed by the Governor of Wheatfield Prison for an alleged breach of prison rules.

Robert Egan (29) of Dromheath Avenue, Mulhuddart in Dublin was found to have received a prohibited item during 2 of his partner's visits in June.

The court heard the mother of his 2 children has since been barred indefinitely from visiting the prison.

Egan claims the Governor made adverse findings against him based on CCTV footage of his partner's visits which he was not allowed to view.

His lawyers, led today by John Ward BL, argued that there has been a breach of the prisoner's constitutional right to fair procedures.

The case was brought to court today on an ex-parte basis.

The sanctions imposed on Robert Egan by the governor include a ban on phone calls, evening recreation and ordinary prison visits for 56 days.

Egan is serving a 12-year sentence for the manslaughter of father of two Wayne Doherty, who was shot in Dublin in 2009.

High Court President Nicholas Kearns has lifted the prison sanctions until Friday when the Governor of Wheatfield and the State will have an opportunity to air their side of the case.
