The High Court has quashed a finding of poor professional performance against a consultant paediatrician over a tongue-tie procedure on a young child.
Professor Martin Corbally, with an address at Corballis, Donabate, Co Dublin but working in Bahrain, took action against the Medical Council after he was sanctioned last year.
The procedure on the lip of a child (2) was carried out by a registrar at Our Lady’s Children’s Hospital in Crumlin, 3 years ago.
Professor Corbally was admonished last year by the Medical Council after its Fitness to Practice Committee found that he incorrectly described the procedure that was required in his outpatient notes.
He challenged a finding of poor professional performance in the High Court which has ruled in his favour.
High Court President Nicholas Kearns has concluded the error was not a very serious one, that the paediatrician was blamed for a systems failure and that the findings and penalty were disproportionate.
He noted that the senior surgeon had been censured following a hearing that attracted widespread public attention.
