The Commercial Court has ruled in favour of the Irish Bank Resolution Corporation (IBRC)  cross examining family members of jailed businessman Sean Quinn about their assets and bank accounts.

The former Anglo Irish Bank will question the 5 Quinn children -  Aoife, Brenda, Ciara, Colette and Seán Junior - and 3 of their spouses Stephen Kelly, Niall McPartland and Karen Woods on disclosure issues.

Some of the questions will relate to the control of the Quinn International Property Group and the alleged transfer of assets to off-shore companies.

Questioning necessary to 'fill vacuum'

It is part of broader proceedings by the bank alleging a conspiracy among the Quinn's to wrongfully appropriate assets.

Martin Hayden, SC, for the Quinn's branded the cross examination request  as an unlawful fishing exercise.

However Mr. Justice Peter Kelly has found there are issues that require to be elucidated and he believes cross examination is necessary to 'fill the vacuum'.

He said this would not be a mini-trial and the Quinn's entitlements against self incrimination would be unaffected.

The cross examination will take place on January 24th and 25th.
