A TD has been accused of 'abusing' Dáil principles after raising the George Nkencho case in the chamber.
Ceann Comhairle Seán Ó Fearghaíl suspended proceedings earlier after People Before Profit TD Mick Barry repeatedly tried to talk about the decision not to prosecute a Garda.
Yesterday the Director of Public Prosecutions (DPP) said a member of the force who killed Mr Nkencho would not face prosecution following an investigation.
Mr Nkencho was shot outside his family home in December 2020 after an alleged assault with a kitchen knife in a shop.
Gardaí said the decision was taken after non-lethal measures were unsuccessful.
'Separation of powers'
In the Dáil today, Mr Ó Fearghaíl said members of the House cannot comment on the independent decisions of the DPP.
"We have, as a matter of long-established principle here, the separation of powers," he said.
"The separation of powers means that in this House we do not criticise or comment on affairs before the courts.
"The Director of Public Prosecutions is independent in their remit and their actions and decisions may not be commented on here."
Deputy Barry said he believed the case was one of "public importance" but Mr Ó Fearghaíl disagreed.
He then suspended the Dáil for 10 minutes.
