Limerick man John Dundon is asking the High Court to delay his trial for the murder of Garryowen rugby player Shane Geoghegan until next year.
Dundon, 30, called a judge at the Special Criminal Court a 'big fat pig' last week after the non-jury court ruled the case could go ahead there as scheduled on June 4th next.
The High Court has agreed to review that decision.
John Dundon's lawyers say their client's right to a fair trial is in jeopardy.
They say it is 'not humanly possible' for the defence to process the vast quantity of documents recently disclosed to them by gardaí, ahead of next month's start date.
The court heard over 26,000 documents have been handed over since late April, along with more than 1,200 discs of CCTV footage, two hard drives and memory sticks.
The documents were described as being 'unpaginated', and in some cases dog-eared and in poor condition.
It is argued that it took gardaí seven months since John Dundon was charged last October to put together these documents for the defence, which is being asked to review the same body of work over four weeks.
Today's application was made on an ex parte (one side only) basis.
Mr Justice Michael White is allowing the challenge to proceed. The Director of Public Prosecutions is to be put on notice of the case which is due to return to court tomorrow.
