Graham Dwyer, an architect from Foxrock in Dublin was charged with Elaine O'Hara's murder
But because his appeal was denied by the High Court he will need to bring the case to the Supreme Court.
Elaine O'Hara disappeared in August 2012. Her remains were discovered by a walker in the Dublin Mountains last September.
O'Hara was originally from Killiney in south Dublin and was reported missing by her father on August 24th 2012, two days after she was seen leaving her home in Stepaside.
By coincidence, her mobile phone, keys and other personal belongings were found in a reservoir in Roundwood, Co. Wicklow just days beforehand.
GardaĆ ran through possible suspects whose contacts were on Elaine's phone. It's understood O'Hara and Dwyer may have made their acquintance through a website they both used.
