Gardaí have said new laws will not be needed to deal with legal challenges to the GoSafe speed cameras. Gardaí have told the government that there is no major flaw in the law.
A series of cases have been thrown out of courts around the country, over questions about whether GoSafe staff are allowed to present evidence in court. Justice Sean McBride threw out 17 cases at Monaghan District Court on December 3 as he believed the "chain of evidence was inherently flawed."
Junior minister Aodhan Ó Riordáin has told the Dáil that Gardaí may consider appealing those cases to higher courts. Mr Ó Riordáin said “garda authorities [are] carefully studying the recent rulings and taking legal advice, including with respect of the possibility of seeking clarification from the higher courts.
“This is being addressed by the garda authorities as a matter of urgency and developemtns will be reported to the minister,” Mr Ó Riordáin added.
