The High Court has refused Enoch Burke’s application for an injunction preventing a disciplinary hearing from going ahead at Wilson’s Hospital School in County Westmeath tomorrow.
In his ruling yesterday, the judge decided that Mr Burke’s arguments had merit but indicated the application would be refused if he continued to attend at the school.
Mr Burke was suspended from the school last year as a result of alleged misconduct arising from his refusal to address a transitioning student by a new name.
He has continued to breach court orders preventing him from attending at the school pending the outcome of the disciplinary proceedings.
Mr Burke was given until this morning to consider his position but his application was turned down after the judge was satisfied he didn’t intend to comply with the order.
