A court has heard receivers who took over a Co. Longford pub received an invoice for €10 million from the former owners for trespass.
High Court President Nicholas Kearns has ordered that Fallons Pub in Newtowncashel is to be handed back into the receivers' hands after the premises were broken into and occupied.
The court heard there was no opposition from the owners earlier this year when receivers took possession of Fallons Pub over unpaid bank loans.
However recently the pub was broken into and re-occupied.
Claims that it has been trading again were rejected in court by the former owners' son Ryan Fallon.
High Court President Nicholas Kearns said he was acutely conscious of the hardship endured by ordinary men and women but pointed out there were lawful ways of challenging the appointment of a receiver.
The judge said 'what has been done cannot be tolerated...whoever is in there has to get out'.
He has made orders that the bar is to be handed up to the receivers without obstruction.
