Irishman Keith Byrne is on the way home to his family after being released from custody in the US.
The father of three was arrested earlier this month by immigration officials who found he had illegally overstayed his visa.
A US Federal judge has now ordered that he be released from prison and have his deportation order frozen.
The emergency motion - a petition for writ of habeas corpus - was filed in Pennsylvania yesterday.

Mr Byrne entered the US under the visa-waiver programme in 2017, but overstayed after meeting his future wife Keren.
The father-of-three was arrested by US Immigration and Customs Enforcement agents (ICE) last week, and has been facing deportation.
However, he'll now have the opportunity to make his case in another federal court.
Keith's lawyer Thomas Griffin explained: "At the end of the hearing... the judge ordered the government to release him.
"The order was clear that he be released in order to pursue his case in a court closer to his house."
Mr Griffin added: "He can work, make money, support his family and ask for due process.
"He may end up deported at the end of the hearing - if we lose, ICE can come back in and take him. But during this temporary stay and release, the whole purpose is so he can make his case one more time."
Keith's father Jim said they're hoping Keith will be home today, but it could be tomorrow if there's paperwork to sort out.
Jim said: "It's just one victory, and they're going to have to go through it again.
"But it's the first time I've spoken to Keith's wife since that happened that she wasn't crying - she was happy."
