A high-profile defence lawyer in the US says Irish nanny Aisling McCarthy-Brady is facing a trial by media before the full facts of the case are known.

The 34-year-old from Lavey in Co. Cavan is accused of injuring one year old Rehma Sabir in the US.

The baby later died in hospital.

The Boston Herald says determining exactly how Rehma died "could take weeks", further delaying the decision whether to upgrade charges against McCarthy-Brady.

It quotes pathologist and former medical examiner for the State Jennifer Lipmanan as saying that specialized autopsy examinations are part of the extended process.

Aisling 'thrown to the dogs'

While on Wednesday the Associated Press described the scene inside the bedroom of the 1-year-old from court documents as "gruesome".

Elaine Whitfield-Sharp defended British au-pair Louise Woodward over a decade ago.

She says the Irish nanny is being thrown to the dogs before the results of forensic tests are known.

And she says prosecutors in the US make statements to the media to gain an advantage.

She spoke to Breakfast here on Newstalk.
