A man accused of attacking gunman Tristan Sherry in a Dublin restaurant, where he died on Christmas Eve, has claimed “he acted in self-defence”, a court has heard.
Twenty-six-year-old Tristan Sherry, was killed following a shooting inside Browne's Steakhouse in Blanchardstown in which another man, Jason Hennessy Snr, 48, was also fatally injured.
Wayne Deegan, 25, of Linnetsfield Avenue, Phibblestown, Dublin 15 is charged with producing a knife as a weapon during an offence, assault causing harm to Tristan Sherry and violent disorder by using or threatening to use violence with two other men.
Bail
Mr Deegan did not apply for bail after being charged last week; however, he did apply to be released on "stringent" conditions today.
A Garda objected to the application, citing the seriousness of the offence and said other customers were in the restaurant at the time and the accused could be a risk to those witnesses or the second gunman.
The Garda agreed with a defence solicitor the case was based on CCTV evidence and the accused claimed he acted in self-defence.
The Judge ruled against some of the objections, however, Mr Deegan was refused bail.
He was remanded in custody to appear again on January 26th.
Two other men have been charged with the murder of Mr Sherry; they were both previously remanded in custody and are due before a court again later this month.
Jason Hennessy Snr was shot in the neck and upper body while having a meal with family and friends.
He was rushed to hospital but died last week, which saw a separate murder investigation launched.
