The partner of Marie Fleming, who lost her battle with Multiple Sclerosis this morning, says she died in his arms. Tom Curran told the family solicitor that "she died at home, as she always wanted to do."

Ms. Fleming failed in her landmark right-to-die case earlier this year.

In April, her landmark case was brought to the Supreme Court. She argued that the ban on assisted suicide discriminated against people with disabilities and breached her constitutional rights.

She believed her partner Tom Curran should be immune from prosecution had he helped her take her own life.

However the Supreme Court ruled against her, saying there was no Constitutional right to die. There have since been calls for TDs and Senators to legislate for assisted suicide here.

The Tanaiste Eamon Gilmore says her campaign was brave and courageous, adding that the fact that her case has kick-started a national debate will be her lasting legacy.

"Pursuing her campaign - at both political and legal levels - was always going to be a challenge, (and) her deeply-held conviction meant it was one she was never going to back away from" he said.

"Marie successfully highlighted the complex issues that affect people who find themselves in a situation like hers, and the fact that her case has kick-started a national debate on these matters will be her lasting legacy" he added.
