No Gardaí will be prosecuted over the death of Rebecca Browne, it has been confirmed.
Ms Browne died after being hit by a Garda patrol car in May 2023 at Ludden, near Buncrana, in County Donegal.
Yesterday, the Director of Public Prosecutions (DPP) informed it of its decision not to direct a prosecution and notified all relevant parties.
The 21-year-old’s family have said they are devastated that no Gardaí involved in the crash will be prosecuted over her death.
Madden & Finucane Solicitors, who are representing the family of Ms Browne, have requested “the full written reasons, together with all documents, consultation notes, expert opinions and reports and memoranda” which have given rise to this decision.
The family intend to challenge the decision by way of Judicial Review.
Criminal investigation
A statement from the Garda Síochána Ombudsman Commission (GSOC), who conducted an independent criminal investigation of the incident, said they had “noted the DPP’s decision” and has “notified interested parties in the case” - including the Browne family and Garda Members involved.
“GSOC has further notified the Browne family of their entitlement under the Criminal Justice (Victims of Crime) Act 2017 to a summary of reasons from the DPP for its decision not to prosecute, as well as their statutory entitlement to request a review of the decision,” the statement read.
“While GSOC can make no further comment at this time, it will continue to engage with the Browne family in the context of Coronial proceedings and any other statutory processes that may arise.”
Ms Browne had visited Buncrana with her cousin for a night out when she was fatally struck by a Garda patrol car.
