Mark Molloy and his wife Roisin lost their son Mark at Portlaoise Hospital in 2012.
Last year, Roisin spoke to Jonathan Healy about the investigation into the case involving their child calling the affair a "defend and deny process".
Earlier this week, the Irish Times reported that they had seen a HIQA draft report into care at the hospital. However, the families have not been made aware of the report's findings.
The report has been delayed by a row involving HSE and the health watchdog.
Mark Molloy spoke to Jonathan Healy today about the report, the options open to the Minister and stated that the legal threat to the report adds "insult to injury".
"The bottom line, Tony O'Brien speaks of hearsay and unverified accounts. He's calling the accounts of the families into question.
"Our son is dead, if he wants to come to the graveyard in Castlebrack, he can see Mark's little white cross, that should be enough verification for him.
"On a bigger scale, this is the first time that the practice of senior HSE management called into question and that's why we're seeing this kick back.
"In our opinion, the game is up."
