The HSE and Kerry General Hospital apologised unreservedly to three-year-old Skye Worthington, who was left brain damaged at birth, in a statement the judge described as "out of the ordinary" yesterday in the High Court.
The family settled the action yesterday against the HSE which resulted in an interim payout of €2.52m.
The court heard yesterday that Skye has cerebral palsy and can only communicate with her eyes. They also heard that if she had been delivered fifteen minutes earlier, Skye would not have been injured.
Skye’s mother Colleen Worthington spoke to Jonathan Healy on Lunchtime today and said that they wouldn't term it as brain damage, rather as a brain insult.
Following the apology yesterday, Colleen told Jonathan that it "wasn't just a formation of words, it was very meaningful.
"One day, Skye will read it and we will be able to explain."
She continued: "We would return the settlement if we could magically enable Skye to walk or to tell us that she loves us.
"She does love us because there's other ways than words."
When asked was she confident had the hospital learned its lesson from the incident, she stated: "We can only hope that we can learn from this catastrophic mistake."
