The Court of Appeal has granted Brian O'Donnell a stay until Thursday when his appeal will be heard.

Brian O’Donnell appeared before the Court of Appeal last night - asking Judge Sean Ryan if he and his wife Mary Patricia are to “continue packing up” their possessions at Gorse Hill in Killiney.

The solicitor - who owes Bank of Ireland over €70 million - is seeking to appeal yesterday’s High Court ruling, which saw him declared a ‘trespasser’ at the property and gave him until 5 o’clock this evening to vacate the premises.

Mr Justice Sean Ryan told O’Donnell that it would be ‘unreal to pretend’ the three judge panel ‘hadn’t any idea what is going on - even if they are judges’.

He told Brian O’Donnell to contact the bank and the receiver - and to be at the Court of Appeal at 10 o’clock this morning where the application would be heard.
