Ian Bailey yesterday lost his civil case for damages against the State and Garda Commissioner.

He was seeking damages over claims gardaí conspired to frame him for the murder of Sophie Toscan du Plantier.

With the end of the Bailey case, the way is finally cleared for the Fennelly commission to publish its report.

In a letter to the Taoiseach earlier this month, Justice Fennelly stated that the Ian Bailey case, which resulted in Mr Bailey suing the State and Garda Commissioner for alleged wrongful arrest in connection with the death of Sophie Toscan du Plantier, was inextricably linked to the secret Garda recordings which caused Mr Callinan to resign.

Ivan stated that there were elements of this that he found truly shocking: "First of all, we are no nearer finding out who murdered Sophie 18 years ago.

"Secondly, it now transpires the bulk of the case that Bailey brought was actually invalid from the get go.

"How come nobody has said who in the name of God was managing this case on behalf of the State that couldn't make the decision before 64 days of hearings, costly roughly €100,000 a day, to say stall the ball here, this is inadmissable.

"The taxpayer is going to have to pay for it."

 The pair also discussed how this is a much wider story and that this case would tie in to the Fennelly report.

Chris said: "For some reason that is still perplexing, the Government chose to attach Enda Kenny's behaviour a year ago on March 23rd to an investigation into taping of conversations into Garda stations.

"What was Enda Kenny's behaviour? We don't know because he won't answer a straight question in public. He refuses to answer questions about his behaviour around the departure of Martin Callanan."
