Kerry TD Michael Healy-Rae says he will not be turning off his mobile phone and will continue being contactable to his constituents.
It comes after the Road Safety Authority (RSA) contacted gardaí over a recent programme involving the Kerry-South representative.
The Irish Times reports the documentary showed Deputy Healy-Rae taking notes and talking on a hands-free while driving.
The TD is heard saying 'Oh God, you're not supposed to write and drive, there's some law about that'.
The programme 'Looking After Number 1' was aired on October 21st last.
Officials from the RSA have also asked RTÉ to be mindful of road safety and not to interview people while they are driving.
Mr. Healy-Rae has told The Pat Kenny Show here on Newstalk that we all make mistakes.
